2. Installation
================================================== =====================

To install the Test Drive Unlimited 2 version of the game, you will need approximately 18 GB free hard disk space for installing the game, for save games, Windows file caching and updating the game.

1) Run the install.exe and follow the installation instructions.
2) The Launcher of the game will appear after installation. Click on the “Run” button to launch the game.
3) If you have selected “custom installation”, and have unselected the autorun option,
→ a) Windows XP - Run the TDU2 shortcut
→ b) Windows Vista/Windows 7 - Run the TDU2 icon in the Games Explorer
4) Wait for the Launcher to download any available patch data
5) Press the “play” button

To switch from Keyboard controls to one of the game controllers, go to the “Controls” section in the options menu, select the button “Detect Device”, and scroll through the options to select and validate your device.

Video quality settings

In the options menu, you can setup the level of quality for the following elements: Environment, Car and opponent, Texture filtering and FX.

· The setting “Medium” corresponds to the minimum requirements.
· The setting “High” corresponds to the recommended requirements.

If you are experiencing low performance with the default graphics settings, try lowering the video resolution, disabling anti-aliasing or other graphics settings.

4. Network
================================================== =====================

To avoid poor online performance, be sure that you close any file sharing, streaming audio or chat programs prior to entering gameplay. These applications can monopolize your connection’s bandwidth, causing lag or other undesirable effects.

If your firewall or proxy support UpnP, please make sure that this functionality is activated. If this option is not available, you will need to set your firewall and router manually by opening the following port: UDP 8889.

In general, you should be able to connect to the game without modifications needed to the router. However, if you are experiencing connection problems and are using a router, we suggest bypassing the router and connecting directly to your connectivity device. If your problems cease while bypassing the router you can try these things:

- Try resetting your router to its default settings.
- Check your router manufacturer's website for any available Firmware updates. If available, download and install those.

Internet connection: Test Drive Unlimited 2 supports only broadband connections.

6. Specific Warnings
================================================== =====================

The driving depicted in this game may not be realistic and is potentially dangerous in real life. Do not try these driving maneuvers when on the road. Always obey local traffic laws.

Important Health Warning About Playing Video Games.

Photosensitive Seizures: Some people may experience epileptic seizures, including loss of consciousness, when exposed to certain types of intensive luminous stimuli, such as quick succession of images or repetition of simple geometric figures, flashes of light or explosions. Even though they may have no prior history of seizures or epilepsy, such people are at risk of having a seizure when they play certain video games that contain such stimuli.

If you or a member of your family have ever experienced symptoms related to epilepsy (seizure or loss of consciousness) due to exposure to luminous stimuli, consult your doctor before playing this game. Parents should closely supervise their children when they play video games. Immediately stop playing and consult a doctor if you or your child experience any of the following symptoms: lightheadedness, altered vision, twitching eyes or muscle spasms, disorientation, involuntary movements or convulsions, momentary loss of consciousness.

The risk of photosensitive epileptic seizures may be reduced by taking the following precautions: Sit farther from the screen. Use a smaller screen. Play in a well-lit room. Do not play when you are drowsy or tired. If you or any of your relatives have a history of epileptic seizures, consult a doctor before playing.

Test Drive® Unlimited 2 End User License Agreement

This Test Drive Unlimited 2 End User License Agreement (this “Agreement”) is between you as the end user (“You” or “Your”) and Atari, Inc. (“Atari”).

IT IS IMPORTANT THAT YOU CAREFULLY READ AND UNDERSTAND THIS AGREEMENT. BY SELECTING “I ACCEPT THE AGREEMENT” LOCATED AT THE END OF THIS AGREEMENT, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT AS WELL AS ATARI’S TERMS OF SERVICE AND PRIVACY POLICY. IF YOU DO NOT AGREE WITH ALL THE TERMS OF THIS AGREEMENT AND DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, PLEASE SELECD “I DO NOT ACCEPT”. IF YOU DO NOT ACCEPT THIS AGREEMENT, THE GAME (AS HEREINAFTER DEFINED) WILL NOT BE INSTALLED ON YOUR COMPUTER.

1. Definitions.

1.1. Documentation” shall mean the Atari privacy policy, posted rules, and instructions and guidelines that Atari makes generally available with respect to interactive entertainment software product entitled “TDU2.”

1.2.
Game” shall mean the interactive entertainment software product entitled “TDU2” in object code form only, and the media, Documentation and any updates provided by Atari to You and for which You are granted a license pursuant to this Agreement.

2. Grant of License; Ownership. Atari grants You a limited, non-exclusive, nontransferable, royalty-free license to use one copy of the object code form of the Game for personal, non-commercial and lawful use on a single computer for purposes of playing the Game by registering for and accessing an account with the Service (as hereinafter defined). Atari does not transfer title to the Game to You; this license shall not be considered a “sale” of the Game. You agree that the Game belongs to Atari and its licensors, including all intellectual and proprietary rights, unless otherwise specified. Atari and its licensors retain all right, title and interest in and to the Game at all times, and regardless of the form or media in or on which the original or other copies may subsequently exist. Any suggestions, ideas or inventions that You voluntarily and optionally disclose to us through any means will be used, or not used, by Atari at Atari’s sole discretion; and, Atari and its licensors will have no obligation to You regarding any ideas or inventions that You disclose through such means. No right, title or interest in or to any trademark, service mark, logo or trade name of Atari or its licensors, suppliers or affiliates is granted under this Agreement. All other rights are reserved to Atari except as expressly provided herein.

3.
Restrictions. You may not (and You agree not to permit another person to):

3.1.
rent, lease, sell, sublicense, assign, or otherwise transfer or copy the Game, except as expressly permitted by this Agreement;

3.2.
reverse engineer, decompile, disassemble or otherwise reduce the Game to a human-readable form, except to the extent that such actions are expressly permitted by applicable law;

3.3.
modify, translate or create derivative works based on or using the Game or any component thereof;

3.4.
remove any copyright or other proprietary notices contained in or relating to the Game and/or any of its components;

3.5.
create any other software that incorporates the Game;

3.6.
use cheats, automation software (bots), hacks, mods or any other unauthorized third-party software designed to modify the TDU2 experience;

3.7.
exploit the Game or any of its parts, including without limitation the client software, for any commercial purpose, including without limitation (a) use at a cyber cafe, computer gaming center or any other location-based site without the express written consent of Atari; (b) for gathering in-game currency, items or resources for sale outside the Game; or (c) performing in-game services in exchange for payment outside the Game, e.g., power-leveling;

3.8.
use any unauthorized third-party software that intercepts, "mines", or otherwise collects information from or through the Game or the Service, including without limitation any software that reads areas of RAM used by the Game to store information about a character or the game environment; provided, however, that Atari may, at its sole and absolute discretion, allow the use of certain third party user interfaces;

3.9.
host, provide or develop matchmaking services for the Game or intercept, emulate or redirect the communication protocols used by Atari in any way, for any purpose, including without limitation unauthorized play over the internet, network play, or as part of content aggregation networks; and

3.10.
facilitate, create or maintain any unauthorized connection to the Game or the Service, including without limitation (a) any connection to any unauthorized server that emulates, or attempts to emulate, the Service; and (b) any connection using programs or tools not expressly approved by Atari.

4.
Protection of Identity/No Expectation of Privacy. You acknowledge that You have no expectation of privacy or confidentiality in any personal or other information You may intentionally or unintentionally disclose as part of the interactions associated with the Game. You should avoid saying anything personally identifying in chat when playing the Game.

5.
Online Conduct. When You play, You agree to be respectful of Your fellow players and never to engage in any behavior that would be abusive or offensive to other players, disruptive of the game experience, fraudulent or otherwise illegal. This includes but is not limited to:
(a) Harassing or intimidating other players;
(b) Using language (whether written or verbal), selecting user, character, club or team names or creating any other content that may be racially, ethnically, or religiously offensive, sexually abusive, obscene or defamatory;
(c) Using content that is commercial in nature such as advertisements, solicitations and promotions for goods and services;
(d) falsely representing that You are an employee of Atari, or any other affiliated or related company;
(e) Disrupting the normal flow of chat;
(f) Making a false report of user abuse to Atari customer support;
(g) Violating any local, state, national or international law;
(h) Using a cheat code, cheat device, or any device that modifies the executable game code or data.
(i) Any attempt to deliberately alter, damage or undermine the legitimate operation of this game, including but not limited to exploiting the ranking system by creating "dummy accounts".
6. Reporting Abuse. To report violations of this Agreement or to inquire about a blocked account, contact Atari support at atarisupport.com.

7. Agreement Violations. If You violate this Agreement in any manner, Atari may, at its discretion and without notice, temporarily or permanently block Your account from the Game and/or reset Your stats and/or rankings in the Game and any other games.

8. Hotspot and Internet Service Providers. Atari and its affiliated companies are not associated with any Internet service providers (ISPs) including hotspot operators (collectively "ISPs"). Atari is not responsible for any damages or injury arising from or related to Your use of ISP services. When You access the Internet, You are providing information directly to the ISP and not to Atari. This information is collected by the ISP and is not shared with Atari. Before accessing the Internet, You should carefully read the ISP's user agreement/terms and conditions and privacy policy carefully.

9. User Generated Content. The Game includes tools that may give You the ability to communicate with other players and to create, post, and distribute various forms of content for and in connection with the Game, including but not limited to pictures, photographs, videos, Game-related materials (including levels and characters) and other information (individually and collectively, "User Generated Content"). You acknowledge that Atari and the other creators of User Generated Content have rights in their respective content under copyright and other applicable laws, and that except as expressly described in this Agreement, such rights are not licensed or otherwise transferred to You. You accept full responsibility and liability for Your use of any User Generated Content in violation of any such rights. You agree that You will not create, transfer, share, send, submit or upload any User Generated Content that:
(a) is protected by copyright, patent, trademark, or trade secret or otherwise subject to third-party proprietary rights, including but not limited to rights of privacy and publicity (unless You are or have permission from the rightful owner);
(b) contains fraudulent statements or misrepresentations that could damage Atari or any third party;
(c) contains any statements or materials that disparage, ridicule or scorn Atari or any third party;
(d) is obscene, defamatory, threatening, harassing, predatory, pornographic, hateful, racially or ethnically offensive, or encourages conduct that would violate any law or is otherwise inappropriate;
(e) is an advertisement or solicitation of business;
(f) is an impersonation of another person; or
(g) violates any of the rules of Online Conduct, other terms of this Agreement or any other terms related to this game.
You agree that Atari and its Licensors are not responsible or liable for User Generated Content submitted or posted by You or by others. Atari and its Licensors do not claim ownership of any User Generated Content that You submit or make available as part of the game, and Atari and its Licensors expressly disclaim any and all liability in connection with any User Generated Content. Atari has no duty to pre-screen User Generated Content.

Atari has the right to edit, remove, block or refuse to post any submitted User Generated Content from any network or Internet site for any reason without prior notice, but assumes no obligation to do so and is not responsible for any failure or delay in doing so. You hereby appoint Atari as Your attorney-in-fact to request from third parties removal under the Digital Millennium Copyright Act or other applicable law or basis, in Atari's discretion, of any of Your User Generated Content posted on a third party network or Internet site. You agree to not contest Atari's request for removal of Your User Generated content from such network or Internet site. You also agree to execute all documents, as requested by Atari, to effect such removal.

10. Atari’s License of User Generated Content

(a) By posting, transferring, sharing or sending User Generated Content in any manner, You hereby grant Atari, its affiliates, licensors and distributors and other users a non-exclusive, worldwide, fully paid-up, transferrable, irrevocable, royalty-free and perpetual license to modify, adapt, translate, create derivative works from, and perform and display Your User Generated Content;

(b) By submitting or uploading User Generated Content in any manner to Atari, You hereby grant Atari, its affiliates, licensors and distributors a non-exclusive, worldwide, fully paid-up, transferable, irrevocable, royalty-free and perpetual license to publish and distribute Your User Generated Content (for free or for profit) and to use Your User Generated Content for marketing and promotional purposes in conjunction with the game or any other aspect of Atari's business; and
(c) You hereby:
(i) Acknowledge that You have received good and valuable consideration from Atari for the license of the rights in Your User Generated Content under this Agreement;
(ii) Agree that Your creation or distribution of User Generated Content is not in any way based upon any expectation of compensation from Atari, its affiliates, licensors or distributors;
(iii) Agree that Atari, its affiliates, licensors and distributors may, but are not required to, use Your name, username, or applicable trademarks in connection with the distribution of Your User Generated Content; and
(iv) Warrant and represent that: (A) You created Your User Generated Content; (B) You have all necessary rights to Your User Generated Content to fulfill Your obligations under this Agreement; and (C) Your User Generated Content does not infringe on the intellectual property or other rights of any third party and is not obscene, defamatory, offensive or an advertisement or solicitation of business.

11. Termination. This Agreement is effective until terminated. You may terminate this Agreement at any time by uninstalling from Your computer all copies of the Game and destroying any copies of the Game that You may have made.

12. Maintenance. Atari is not obligated to provide maintenance and technical support to You for the Game.

13. Upgrades. You acknowledge that Atari may issue upgraded versions of the Game from time to time. Your license to an existing version of the Game may, at Atari’s discretion, expires when new versions of the Game are released. Notwithstanding the foregoing, Atari has no obligation to make available to You any subsequent versions of the Game. The Game will operate only on those hardware and software platforms specified in the Documentation. It is Your responsibility to ensure that You have the appropriate software, hardware and Internet connection to operate the then-current version of the Game. Atari reserves the right to cease supporting any hardware or software platform at any time, with or without notice. Atari may modify the Game at any time without notice. Additionally, Atari may update the Game remotely, including without limitation, the software client for the Game residing on Your machine, without Your knowledge, and You hereby grant to Atari Your consent to deploy and apply such patches, updates and modifications.

14. Disclaimers of Warranty. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND SUBJECT TO THE EXPRESS PROVISIONS OF THIS AGREEMENT: (A) ATARI AND ITS LICENSORS AND SUPPLIERS PROVIDE THE GAME “AS IS” AND WITH ALL FAULTS, AND HEREBY DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF LACK OF VIRUSES, OF ACCURACY OR COMPLETENESS OF RESPONSES, OF RESULTS, AND OF LACK OF NEGLIGENCE OR LACK OF WORKMANLIKE EFFORT, ALL WITH REGARD TO THE GAME (B) THERE IS NO REPRESENTATION OR WARRANTY OF TITLE, QUIET ENJOYMENT, QUIET POSSESSION, CORRESPONDENCE TO DESCRIPTION, OR NON-INFRINGEMENT, WITH REGARD TO THE GAME; (C) THE ENTIRE RISK AS TO THE QUALITY, OR ARISING OUT OF USE OR PERFORMANCE, OF THE GAME, REMAINS WITH YOU; AND (D) ATARI DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE GAME WILL BE CORRECTED.

15. Exclusion of Incidental, Consequential, and Certain Other Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATARI OR ITS LICENSORS, SUPPLIERS OR AFFILIATES BE LIABLE FOR: (A) ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER; (B) ANY DIRECT OR INDIRECT DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, BUSINESS INTERRUPTION, PERSONAL INJURY, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE OR NEGLIGENCE; OR (C) ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER, ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE GAME, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS AGREEMENT, EVEN IN THE EVENT OF THE FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF ATARI OR ANY SUPPLIER, EVEN IF ATARI OR ANY SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

16. Limitation of Liability and Remedies. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED ABOVE AND ALL OTHER DIRECT OR GENERAL DAMAGES), THE ENTIRE LIABILITY OF ATARI AND ANY OF ITS LICENSORS, SUPPLIERS AND AFFILIATES UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS AGREEMENT AND YOUR EXCLUSIVE REMEDY FOR ALL OF THE FOREGOING SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE GAME OR U.S. $5.00. THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.

17. Export Administration. You will comply fully with all relevant export laws and regulations of the United States, including, without limitation, the U.S. Export Administration Regulations (collectively “Export Controls”). Without limiting the generality of the foregoing, You will not, and You will require Your representatives not to, export, direct or transfer the Game, or any direct product thereof, to any destination, person or entity restricted or prohibited by the Export Controls.

18. U.S. Government Rights. If You are, or are entering into this Agreement on behalf of, any agency or instrumentality of the United States Government, the Game is “commercial computer software” and “commercial computer software documentation,” and pursuant to FAR 12.212 or DFARS 227.7202, and their successors, as applicable, use, reproduction, and disclosure of the Game are governed by the terms of this Agreement.

19. Questions/Customer Support. Should You have any questions concerning this Agreement, or if You desire to contact Atari for any reason, please send Atari an email message at: atarisupport.com. All customer support requests are handled via Email. No telephone support requests will be accepted.

20. Successor Agreements. This Agreement may change in the future. In such case, and when appropriate, Atari will obtain Your acceptance prior to the revised version of this Agreement going into effect. You agree that after receipt of any revised version of this Agreement, You will be deemed to have accepted this revised version unless and until Atari receives written notice from You informing Atari that You do not accept the revised version of the Game and that You have removed the Game from Your computer. Failure to remove and destroy the Game from Your computer will be deemed an acceptance of the revised version of this Agreement. Except as provided in this section, this Agreement may not be revised except in writing signed by all relevant parties.

21. Trademarks. “Atari” and the Fuji logo are trademarks owned by Atari Interactive, Inc. “Test Drive” is a trademark owned by Atari, Inc.

22. Miscellaneous. This Agreement is governed by and construed in accordance with the laws of the State of California, United States of America, without regards to its principles of conflicts of law. You agree to submit to the exclusive jurisdiction of any State or Federal court located in the San Francisco, California, and waive any jurisdictional, venue or inconvenient forum objections to such courts. If any provision of this Agreement is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire Agreement between us relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral Agreements between us with respect to such subject matter. This Agreement is not assignable, transferable or sublicenseable by You except with Atari’s prior written consent. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. Any heading, caption or section title contained in this Agreement is inserted only as a matter of convenience and in no way defines or explains any section or provision hereof.
